Applera Litigation Update
MILFORD, MASS., Mar 13, 2003 (BUSINESS WIRE) -- Waters Corporation (NYSE:WAT) was informed on March 11, 2003, of the decision of the U.S. Court of Appeals for the Federal Circuit upholding a District Court's judgment that the Quattro Ultima(TM) series mass spectrometers manufactured and sold in the U.S. by its subsidiaries Micromass UK, LTD. and Micromass, Inc. infringed a U.S. Patent 4,963,736. The patent is owned by MDS, Inc. and exclusively licensed to PE Corporation and Perkin Elmer Sciex Instruments. PE Corporation and Perkin Elmer Sciex Instruments are owned or partly owned by Applera Corporation. The appeal and the judgment do not relate to instruments sold under the trade designation "Quattro Micro(TM)".

The Quattro Ultima(TM) products found to be an infringement are no longer sold to U.S. customers. The company has previously accrued a financial charge for this obligation and does not anticipate any adverse impact to 2003 earnings as a result of this judgement. Waters Corporation is disappointed with the Appellate Court's decision; however, the Company expects to introduce new products to replace the Quattro Ultima(TM) series in the U.S. later this year.
