Receives Favorable Decision in Patent Infringement Action Against the Perkin-Elmer Corporation
MILFORD, Mass.--(BUSINESS WIRE)--Dec. 9, 1998--TA Instruments, Inc., a subsidiary of Waters Corporation (NYSE: WAT), today reported that on December 7, 1998, the U.S. District Court for the District of Delaware ruled, that as a matter of law, The Perkin-Elmer Corporation was liable for infringing TA Instruments, Inc.'s modulated differential scanning calorimetry patents. The decision reverses an earlier jury trial finding of no liability. The Court found The Perkin-Elmer Corporation liable under all seven claims which TA Instruments Inc. had asserted at trial. The decision provides for entry of an injunction, prohibiting The Perkin-Elmer Corporation from any further manufacture, use or sale of infringing instruments. The decision also provides for a new trial to determine damages.
